Medical Liability, the Standard of Care and AI

The gradual embrace of AI in healthcare raises some critical questions. This seminar will explore two inter-connected issues: 

  1. What is the standard of care to be considered when dealing with AI? The main issue is whether the standard of care requires the use of AI or if this (still disruptive) technology should be avoided; 
  2. Who will be held liable when patients suffer harm during the use of AI? This is not only a matter of medical liability but also liability for the product, and eventually a new branch of digital/AI liability. 

Hosted by the University of Bristol Law School and Elizabeth Blackwell Institute, this interactive interdisciplinary seminar features Vera Lúcia Raposo, Assistant Professor of Law and Technology at Nova School of Law (Lisbon, Portugal), who is visiting Bristol in October 2023. She is the leading researcher at FutureHealthLaw which explores the use of new technologies in health care. She is a frequent speaker at academic events worldwide, a member of the Editorial Board of the European Journal of Health Law and Governor of the World Association for Medical Law. She is the author of more than one hundred papers, particularly in digital law (AI, data protection, metaverse) and biomedical law (medical liability, patient safety, gene editing, digital health). Dr Raposo is hosted by Professor Oliver Quick from the Bristol Law School, read more about Professor Raposo here: Vera Lucia Raposo | International Research Development | University of Bristol

The seminar will be an opportunity to 

  • learn about Vera Lúcia Raposo’s work at the intersection of health, law and technology; 

  • explore new collaborative opportunities;  

  • share your research interests in this area with other colleagues; 

  • meet and discuss ideas with colleagues from different disciplines. 

There will also be an opportunity to discuss ideas in the context of an RAI UK-led 'Responsible AI UK international partnerships' funding call.

The interactive seminar will be held in person, and all staff and students at the University of Bristol and our partners in the NHS with an interest in this area are warmly invited.
