ROSE deposit licence

Depositor's declaration

By accepting this licence, the Depositor:

1. Grants a non exclusive, royalty-free licence to Library Services on behalf of the University of Bristol.

2. Confirms that he or she is the owner of the copyright in the whole Work (including content and layout), or is duly authorised by the owner(s) or other holder of these rights to grant under this agreement a licence to hold and disseminate copies of the material.

3. Confirms that the Work is not and shall be in no way a violation or infringement of any copyright, trademark, patent, or other rights whatsoever of any person.

4. Confirms that, if the Work has been sponsored or supported by any organization, he or she has fulfilled any obligations required by such contract or agreement.

The Repository's rights and responsibilities

In return, Library Services shall:

Make copies of the Work (including the abstract) available for distribution worldwide in an electronic format and in any other medium or format for the lifetime of the project, or as negotiated by the Depositor with the repository administrator, for the purpose of free access without charge (except for associated media costs).

6. Electronically store, translate, copy, or re-arrange the Work to ensure its future preservation and accessibility, unless notified by the depositor that specific restrictions apply.

7. Not be under any obligation to reproduce, transmit, broadcast, or display the Work in the same formats or resolutions as that in which it was originally deposited.

8. Incorporate metadata or documentation for the Work in public access catalogues.

9. Retain the right to remove the Work if it is found to be in breach of the law or the University's research misconduct rules, or for any other compelling professional or administrative reason, subject to the approval of the ROSE Editorial Board in each case. A metadata record that cites the Work will remain visible.

10. Not be under any obligation to take legal action on behalf of the Depositor or other rights holders in the event of breach of intellectual property rights or any other right in the material deposited.

11. Where practicable, retain the copyright in any additional data, software, user guides and documentation created to assist users in using the Work, on behalf of the University of Bristol and any other parties with whom Library Services may choose to enter into an agreement to produce such materials.

12. Subject to paragraph 7, take every care to preserve the physical integrity of the Work but shall incur no liability, either expressed or implicit, for the Work or for the loss of or damage to the Work or any of its associated data.

Definition & terms

13.  In this Agreement the following words and phrases have the following meanings:

(a) "Agreement": this document including all of its terms and conditions.

(b) "Non-exclusive licence": the right to hold and distribute the Work but not to prevent its use or publication elsewhere.

(c) "Work": the item being deposited including abstract, text, images and related data.

(d) "ROSE Editorial Board": a committee chosen by Senate and comprising members of the academic staff of the University of Bristol.

(e) "The project": the Bristol Repository of Scholarly Eprints.
