The Law School is delighted to report that one of our recent law graduates, Kelly Scott (LLB, 2014) has been successful in publishing her final year research project in a recent edition of the prestigious law journal, the Criminal Law Review. All final year law students at Bristol are given the opportunity to complete an independent piece of legal research, under the supervision of a member of the academic staff. Kelly’s project was supervised by Dr Judy Laing, a Senior Lecturer in the Law School and was described by the examiners as an impressive piece of legal scholarship. Kelly’s article, entitled ‘Section 136 of the Mental Health Act 1983 and human rights violations: police procedure and the practice of using custody as a "place of safety" for vulnerable individuals’ considers how the practice of using police custody as a "place of safety" to detain vulnerable individuals under s. 136 of the Mental Health Act 1983 may violate Articles 2, 3 and 5 of the European Convention on Human Rights. The articles details how such violations may occur under the current regime and outlines potential solutions, including the adoption of a multi-agency protocol involving greater collaboration between police and mental health practitioners.
